Headstone Mapping Progress

First of all I'd like to thank Candy and James for all of their hard work in keeping the cemetery mowed and beautiful while we take on the mapping part. The cemetery looks beautiful and we're happy to see so many flowers and placements out there.

Betty, Dan, Dave, Gil, and I went out this morning and started the low mow, map and document of the first row. We're starting on the left hand side, working our way clockwise through to map every headstone. Using metal detectors and probes, Dave was able to find a few pretty buried headstones and raise them. We're using a camera with an attached GPS to document the placement of each headstone, and also documenting the full script of the headstones. Our hope is to have an online place for everyone to find their pets, see a picture of the headstone and its location in the future.

This will be a very slow project, one we'll do when the weather and our schedules permit.

In the meantime, enjoy the beauty of the cemetery.

Future work at Bonheur

A year and a half ago we started this effort to restore and provide a means to ensure that Rosa Bonheur and other pet cemeteries would be fairly regulated in the state of Maryland.

Its been tough work, but something all of us have enjoyed not only seeing the cemetery come back alive with flowers, memorials and visitors, but also something we've taken pride in doing.

One of our goals initially was to restore Bonheur to a workable and easily maintained state in the hopes that the owner would realize the importance of the cemetery, and take over the responsibility of maintaining his property. Unfortunately it seems that he is either unable, or unwilling to do this.

Another of our goals was to document, catalog, photograph, and map out the cemetery to show its historical value to Howard County, and to provide a history of the cemetery.

Unfortunately, the maintenance of the cemetery has required that the corps of volunteers spend most of their time fighting the ever growing grass, weeds, and debris each week and has not allowed us the time to document the occupants, find missing plots for people, or work on the bill and lobbying for its passing.

In light of this, we will be discontinuing the weekly mowing of the cemetery and will be concentrating on:
Mapping and documenting the headstones
Working on the bill and lobbying for its passing in the 2008 General Assembly

What this means is that we will be going out when we can to low mow sections of the cemetery. We will be plotting out the cemetery with string and flags again, concentrating only on small sections. Once that section has been plotted and mapped, we will move to another section. In this time, we will not be maintaining the cemetery, and invariably it will grow over again.

We encourage plot owners to make complaints to the Maryland Attorney General, the Howard County Consumer Protection personnel, and your Maryland Senators and Delegates regarding the upkeep of the cemetery, the breach of contract for perpetual care, and any other complaints regarding the upkeep of the property. One of the main arguments for the bill not passing this year was the claim that nobody had complained at all about pet cemeteries in the state of Maryland. We hope you will take advantage of the various agencies and lodge formal complaints about the disposition of the cemetery.

We appreciate everyone's words of support and hope you understand our need to complete the work that we set out to do, which is to document the cemetery, and save it from development.

We got quite a lot accomplished saturday and it looks really nice.

I didn’t get a chance to meet Eddie, but apparently he use to be a groundskeeper at Bonheur back when Marilyn ran the cemetery. He had his mowing equipment and kindly helped out where he could, thank you so much.

Candy and Jason did a great job on the triangle, it looks really nice.

We’ll send out the word when the next mowing will take place.

MOW FEST SCHEDULED!

On 12 May 2007 from 10am until 2pm we'll be having a mow fest.

Bring your lawnmowers and drinking water and help us fight the growing grass of Bonheur!

If you don't have a lawnmower, you can still help. We need people to walk in front of the mowers and move the flowers and ornaments so the mowers can mow!

Update on SB 797

As you may have guessed by now, SB 797 was killed in the House Business Regulations sub-committee. I will be receiving a copy of the vote in that sub-committee and posting who voted for what in the near future.

What’s next?

Well, same as usual for us. The volunteers will be trying out a new schedule for maintaining Bonheur. Instead of every Sunday, we will be trying out a marathon mow session one weekend a month to see if that will work as far as keeping the grass to a reasonable level. We certainly don’t expect the owner to lift a finger to help, but if you would like to help, we’ll send out the schedule well in advance. Anyone with lawnmowers are more than welcome, and if you don’t have a lawnmower, come out anyway, we need people who can lift the flowers, ornaments, and other items while we mow.

We will be contacting Senators and Delegates during the “off season” and will be actively lobbying the bill for next year. We hope to have sponsors in both the House and Senate next year so that we can push the bill through both places at once and get it passed finally.

What can you do? Complain. Complain to Howard County, complain to the cemetery oversight committee, complain to your Delegates and Senators, complain, complain, complain! I’ll send out a contact list of people you can complain to throughout the year.

We need people to complain about this problem, because we apparently haven’t made it clear that there is a problem, despite all of our work and press.

I wanted to thank all of you for helping us out this year, and in the next year until the Session starts again in January 2008.

The hearing was today for SB 797 (the pet cemetery bill).

I wanted to thank Dave and Ruth for testifying on behalf of pet owners, and Diane (the bill's author) and Senator Stone.

Here are some of the issues that the lawyer for Bonheur testified against the bill.

1. He said the bill was "overly broad".

2. He objected to the criminal penalties, seeming to believe that they were too harsh.

3. He said that there have been only "minimal" complaints about pet cemetery problems, and that there are only 15-20 pet cemeteries in the state.

4. He said that there is no need for this legislation (for the reasons given in point 3).

5. He called the bill "onerous and extreme".

6. He said that the Bonheur owner was working for a "long-term solution" with the pet owners.

7. He said that the bill should not be applied retroactively; i.e. should apply only to new pet cemeteries, established after October 2007. He said that existing pet cemeteries should be exempt.

8. He said that the bill should not contain criminal penalties.

While I'm sure that none of you agree with his position, and are probably outraged at his remarks that are clearly in the best interest of his client, a man who was quoted in the Baltimore Sun as saying that he has the means to maintain the property, but why should he when volunteers are doing it... then you need to call the Economic Matters Committee and tell them that you are one of the "few" pet owners who have complained to deaf ears, that the Bonheur owner has done NOTHING in 5 years and continues to say that he's selling the land to build condos and use the cemetery as "green" space, which is NOT what you paid for. You need to tell them that it needs to apply to ALL pet cemeteries, not new pet cemeteries, and they need to pass this very important and vital consumer protection bill to a full House vote.

Hearing for SB 797 Rescheduled

The Business Regulation subcommittee of the Economic Matters Committee will hear SB 797 on 3 April 2007 at 1pm.

We are not sure if we will be allowed to testify, but if you would like to show up, please do so before 12pm. If they are allowing testimony, you will be required to sign in before 12pm in order to testify. If you would like to leave written testimony, you will need to submit it prior to 12pm and you will need to give them 40 copies of your testimony.

If you can’t be there for the hearing, or drop off 40 copies of testimony, please at least call the Economic Matters Committee and tell them you support SB 797 and want it passed. Their number is: 410-841-3519.

Update on SB 797 (the Pet Cemetery Bill)

SB 797 has passed the Senate floor with a vote of 47-0!

We want to thank (again) the Senators who see this bill as an important step in protecting pet owner consumers!

The bill is now on the way to the House and will most likely be heard (again) by the House Economic Matters Committee. If allowed, we will be going to testify again for the passing of this bill.

As you may recall, the bill was heard by the committee last year and recommended it be held over for “summer session”, which is House lingo for “kill it”.

We hope the House sees the error in their ways last year that allowed more pet owners to be duped into buying plots and burials that are not regulated by the State of Maryland.

I will be posting a list of the members of the Economic Matters Committee in the next update. PLEASE pass the word and have everyone you know call these Delegates and tell them to pass this very important bill, that will allow pet owners the right to bury their pets in a PROTECTED cemetery!

Hearing Set for Pet Cemetery Bill!

The Senate Finance committee has scheduled the hearing for the Pet Cemetery Bill (SB 797) for 15 March 2007 at 1pm.

The hearings start at 1pm, that doesn't mean that it will get heard first, so be prepared to wait around.

The more people, especially pet owners and plot owners, that can come and testify, or even just come to the hearing so that we can represent you when we testify will help us persuade the Senate to pass this bill again!

Here are the rules for testifying:
Anyone wishing to testify on any bill must sign the witness register by 12:30 p.m. If you have written testimony, please submit 20 copies to the committee staff by 12:00 noon for distribution prior to the hearing. The order that bills are listed on the schedule is not necessarily the order in which they will be heard.

You don't need to write a fancy speech, you don't need to dress up, just come and tell how, as a consumer that purchased plots for your pets, that you were ripped off due to the lack of laws for pet cemeteries! Tell them how you paid for perpetual care that was not honored, tell of plots you purchased that you are no longer able to use.

If you know of anyone that has a plot at Bonheur or any Maryland pet cemetery who doesn't subscribe to this list, please tell them that we need their help on 15 March 2007 to get this bill passed onto the Senate floor for a vote.

10 February 2007 Update

Hi everyone,

Sorry the updates have been a bit few and far between. Rest assured that things are still getting done, its just slow in the winter months, there's very little work that we can do out there when the ground is frozen.

We will be out tomorrow morning at 10am, probably not for long. We're just making an appearance and picking up the usual trash that gets blown into the cemetery.

Thanks to Dave's many phone calls to Howard County, the County has apparently smoothed out the driveway and road a bit from the water main break. Thank you Dave for making them fix that. The pipe is apparently still out there, but from what we understand there will be new pipe getting put in, so I'm sure there will be additional construction going on out there.

Now I'm sure all of you are waiting to hear about the bill. Senator Stone and his wife Joane are putting the bill in. There has been some protest going on from yet another lawyer about this bill, which has sorta delayed its entry into the system, along with the fact that it was an election year, there are new people in the Senate and House and they are throwing in all sorts of bills willy nilly. Rest assured that the bill is being submitted by Senator Stone. It will go through the same process as last year, which means it'll go to a committee and get heard, so we'll need people to show up for those committee hearings and testify, then if it passes, it goes to the Senate for a vote, if it passes there it goes to the House and it'll get assigned to a committee, so we'll need people to testify there, especially if these lawyers start coming out to oppose it.

I wish it was easy, especially since to you and I this seems like the right thing to do, but its not. This is the process and we just have to fight and scratch for what is right just like last year.

I will be posting more when I find out, so keep checking the web site and the blog and your e-mails for news on when its scheduled for a hearing and I invite everyone out to help us fight for the Pet Cemeteries in Maryland and for Rosa Bonheur.

7 January 2007 Update

As mentioned in the previous update, there was a water main break at the entrance of the cemetery that caused massive amounts of water to flow into the cemetery by way of the road.

The road is washed out pretty badly, all the way down to the original asphalt, and dirt, sand, silt, and rocks washed onto some of the headstones in the triangle and to the right of the triangle.

Armed with shovels, rakes, and hoes, we spent two hours digging out the headstones from this mess. We've decided that mowing is a lot less strenuous than digging.

Dave contacted the Howard County Public Works and found out that it wasn't the planned construction to replace the water pipes in that area, but an actual water main break (which is why they are replacing those pipes). Dave has asked what Howard County is going to do to repair the damage to the cemetery, but we aren't holding our breath for a fix.

Although we managed to dig out most of the headstones, we fear that with the upcoming rains, we'll have more digging to do, as there is a lot of loose sand and rock still around the area. The following pictures are of us at work today (thanks to Betty for taking the pictures):

31 December 2006 Update

Gil and I were unable to make it out today because one of our dogs ruptured a disc in his back and had surgery on the 27th. We expect him to make a full recovery, but he's restricted to a crate for 8 weeks and walking with the use of a sling.

Dan, Betty, and Dave managed to get out there today, expecting to do some touch up work and perhaps raise a few headstones, but when they got to the cemetery, it was obvious that there had been a water main break right at the entrance to the cemetery.

Dave had gone out on Tuesday to lower the flag to half staff for President Ford, and it hadn't happened then, so sometime between Tuesday and today the water main break happened. It appears that a large amount of water flowed down the road, washing up the gravel road and depositing the gravel and dirt onto some of the headstones. Dave took pictures, some of which are below and others are located on his Website at: Dave's Pictures

We'll be out next weekend with shovels to clear the dirt and debris from the affected headstones. If anyone has a contact with Howard County Public works and would like to call them to see if they are responsible for cleaning up the damage, that would be cool.

Merry Christmas everyone, and I certainly hope that if you had the opportunity to go visit your pets, that it was a much better experience than last Christmas.

We went out today mainly to try to locate Tonya Tinker, and I'm sad to say that we were unable to locate her. Even armed with a metal detector and cemetery probes, we found a lot of sunken headstones, but have yet to locate Tonya. We will keep trying.

We've also come to the conclusion that we will need to stake out rows and columns in order to determine the exact layout of the circle. We do know that when the Potee's had the cemetery, they were very methodical about how it was laid out. We know that in the more current years, that the other owners did their own numbering and layouts, so we can't rely on the deeds as far as where plots are located.

Since the grass has stopped growing, and as long as the weather holds out, we'll try to use string and stakes to plot rows and columns and raise and detail headstones in the circle area for a better idea of how its laid out.

We will also be ramping up the effort to get the cemetery bill passed in the next week or two. The Maryland General Assembly will be coming together to start their sessions, so we'll be hitting them fast and hard to get this bill introduced, through the switches and voted on as soon as possible. We will need your help and will let you know when to start making phone calls.

17 December 2006 Update

Wow, another beautiful day out today, and we were happy to see a lot of people coming out to visit their pets, place holiday flowers and enjoy the cemetery.

We continued to mow the left hand side, made a lot of progress today. We stopped and looked and remembered what it looked like almost a year ago, and although its not "perfect", we are amazed at what a difference just a little mowing makes. Sure its hard work for 5 people with push mowers, but it wouldn't be anything for a crew of 2 people and a riding lawn mower to mow it even once a week (1 person to mow, the other to remove and replace flowers, ornaments, etc.) it would take all of 1 day to mow. Seems a shame that the current owner can't even do something that simple, that decent.

We were able to find Gina for her loving owners. We couldn't locate Tonya Tinker though. We'll need to break out the metal detector and probes for that, which we will be doing next Sunday, Christmas Eve. We will be out there at our usual time, but instead of mowing, we will be finding Tonya Tinker, and anyone else that we can, raise their headstones, and honor them on the eve of Christmas. If you would like to bring some candles, we'd like to light some for the holidays, as most of the standing candle holders will still work. We thought it would be a nice little special something for the holidays.

We hope that you will make some time to come out and enjoy the cemetery, be with your loved ones, and on Christmas Eve if you'd like to come out so we can help find your pet, we'd be happy to do that. We will be out there at 10am, as usual.

10 December 2006 Update

Another lovely mowing day today. We really do love the cool weather, makes for a nice few hours of mowing.

We're happy to report that the grass growing has slowed dramatically and the circle still looks wonderful. People are starting to come out and put up their christmas memorials and it looks really nice.

We're trying to get the rest of the cemetery mowed down now. Today we mowed the triangle again, then the front gate and Betty put up some wreaths and flowers.

We're planning on coming out every sunday until it starts snowing so that we can get a good base foundation to start with once spring arrives. We hope that at that time, the bill will be passed and we'll be able to hand the cemetery maintenance over to the owner, who shouldn't have any problems as long as its mowed once a week.

As a final note, we found Ginger O'Connell, raised Ginger's headstone, mowed a path to her, and put some flowers to keep her pretty:

We have to say, we like mowing in cold weather :)

We finished up the circle today, it looks very nice, and from what we could tell, there was barely any growth on the back half of the circle which was mowed 2 weeks ago, so that's a good sign.

We're hoping that the weather holds out for us so we can do a final mow on the left hand side to get it down before the snow starts falling. Regardless, we stood after mowing and looked around and realized that even though its not perfect, it looks so much better than it did this time last year. I'll go out next sunday and take pictures after we mow and post a comparison of 2005, versus 2006. Quite a difference just mowing makes in the drainage, look, and feel to the place.

We've noticed more flowers out on headstones too, thanks for coming out again and we hope you are able to find your loved ones.

We've received some private e-mails from people asking for our help to locate loved ones. We are more than happy to do that, just send us an e-mail or even post a comment here. If you have records that you can copy, we'd like a copy, as it would help us map out the cemetery and help others locate their pets.

We are also gearing up for the start of the 2007 General Assembly, so please keep checking back for updates, and we'll also need people to help us lobby (which is a nice way of saying "bug") our elected officials to get the Pet Cemetery law passed here in Maryland.

We were mildly surprised that with all of the rain, the ground wasn't too muddy to mow. It was actually a nice day to mow, slightly chilly so we didn't get hot, and we did get a lot accomplished.

We mowed the back half of the circle, which was the highest of all of the cemetery. We've seen where people have come out and trimmed around their loved ones' plots, and placed fall flowers. It very pretty out there, and although not perfectly manicured, we had to stand and remember what it looked like almost a year ago, and decided that it looked really beautiful out there.

As next weekend is Thanksgiving (wishing everyone that reads this a wonderful Thanksgiving holiday) we ourselves will be taking the whole weekend off to be with loved ones, but our hearts will still be at Rosa Bonheur.

In the meantime, it is time for us to reach out to our elected officials, and re-acquaint them with SB983. We'll be doing some e-mailing and also reaching out to newly elected MD State Attorney Doug Gansler for his support in enforcing the bill once it is passed. Soon, we'll put the call out to those who want to help us with the bill, even if its calling your representatives and putting a bug in their ear.

We don't know how much longer the weather will hold out to allow us to keep working, but just because we aren't out there, doesn't mean we aren't doing something to save this wonderful place.

Work for 12 November 2006

Well, work for tomorrow is looking a bit grim, what with the predicted rain we're suppose to get.

Last week we did manage to mow the rest of the right hand side as you come in, and the very front of the cemetery.

We're still waiting for the official election results to finalize with the counting of the absentee ballots. Once the winners are announced officially, we will be sending out congratulatory e-mails to the winners, introducing the group to the new-comers in office, and reminding them that once they're settled into office, we would like some time to speak to all of them about the former SB983 pet cemetery bill. During the 2007 session it will be reintroduced and called something else, but until then, we'll continue to call it by its old name.

We will also be contacted Doug Gansler, the state's new attorney general, to get his support for the passing of the bill. It will be instrumental to have his support, because it will be his office that will be in charge of ensuring the laws are followed in all cases. I had already received his support for the bill prior to the elections and I don't think that will change now that he's been elected.

So, just wanted to send out an update. Even though we can't work on some weekends, we are still fighting hard for the bill, and for changes to be made in how pet cemeteries are treated in the state of Maryland.

15 October 2006 Update

Hey everyone,

It was actually a beautiful day for mowing out there, very cool and nice out.

We were very pleased to see that the grass barely grew in the triangle from our mowing last weekend. We think with the cold snap, the grass growing has finally slowed down some.

We are still planning a big "Mow Down" in the next week or two, as soon as Dan and Betty can borrow the mower, AND we get decent weekend weather. We look forward to meeting some of you when that happens, and hope you can come out and at the very least, enjoy a nice day at the cemetery with us.

We will announce the day once we get everything coordinated and make the announcement as soon as we know, just pray for a good day once its scheduled.

Mow Down is Postponed

Due to the wet weather, we are forced to postpone the Mow Down of the cemetery this weekend. We are unable to bring out the tractor and use it when the ground is this wet.

We will be rescheduling the Mow Down, and will give advanced notice of the date for those of you who want to come out and help.

We will be out on Sunday to see what we can do if the ground has dried out a bit from all this rain. We'll be out at the usual time 10am until 12pm.

You Are Invited to a Mow Down!

October 7 and 8 we'll be bringing out the big mower to do a mowing of the entire cemetery in preparation of this coming winter season!

We'd like for you to join us!

What can you do to help?

We need people to walk in front of the mower to make sure it won't hit any headstones that are sticking up out of the ground, and remove/replace flowers.

We need people to bring rakes to rake up the big piles of grass.

We need people to stand and hold garbage bags for people picking up the big piles of grass.

We need anyone who just wants to come out and cheer us on :)

Mowing will start on 10am Saturday, and end when we fall down exhausted. If the whole cemetery isn't completely mown by then, we'll be out again on Sunday.

We'd love to see you out there, if anything just to have a nice time in a very tranquil and lovely place.

24 September 2006 update

Well, once again, we believed weather.com and felt it would be better not to go out as there were storms predicted. As usual, it was a nice day.

Luckily, Dave didn't get the message and went out by himself and mowed. As he put it himself , he was able to make up some lost time with all his travel, so thanks Dave!

Weather permitting, we'll be out next Sunday (and not believe weather.com anymore) to continue on with the work.

10 September 2006 Update

The gang is all back from vacation and out mowing this morning. We mowed 1.5 sections on the left hand side. The grass is really starting to slow down its growth, but the weeds seem to have a mind of their own. Don't worry, we'll take care of those as well.

We'd like to point out that we took 2 weeks off from cemetery work, and in that time, Mr. Tertel, the owner, didn't bother to do anything to his property. Silly us, we thought we could believe him when he stated that he could take care of the cemetery at any time, but didn't have to because we were doing it for him.

The Primary elections are on Tuesday, please go out and vote for those who will support the pet cemetery bill and protect pet owners from unscrupulous businesses.

I received a very nice e-mail from Mr. Doug Gansler who is running for Maryland Attorney General. His record for prosecuting animal cruelty cases, his creation of an animal law section, and other pro-animal, pro-consumer cases and his support for the pet cemetery bill makes him our choice for Maryland Attorney General for the Primary.

Due to Ernesto, we took the weekend off since we knew it would be very squishy out at the cemetery this weekend.

We did go out to see if there was any damage from the winds, and except for some good sized branches, and some fallen flowers, everything looked pretty good. It seems as though the grass growing is slowing down a bit. That's a good thing as we can now start raising and detailing headstones soon.

Our next cleaning session will be next Sunday 10 September 2006 from 10 until noon, weather permitting. Soon we'll be dealing with all the leaves from the trees that are now falling.

We had a very nice time at Diane Nixon's fundraising in Silver Spring last night. We were able to talk with a lot of new people about SB983, pet cemeteries in general, and found some more supporters to our cause, including Jamie Raskin, who is running for State Senate. Mr. Raskin had already responded positively to my question about supporting SB983 (see Senate responses).

We'd like to encourage all of you to check out who will listen to you in office, and vote for those who are for consumer protection, specifically in regard to SB983. After the election fray is over, we will once again be lobbying for the bill well in advance of the start of the January 2007 session to ensure that it is not only introduced early, but also introduced in both the House and the Senate. We will need your help to put the pressure on those in office to make this bill pass and become a law.

We mowed the triangle section today, since the rest of the cemetery still looked pretty good from the big mower, and the triangle hadn't been done in a while.

Gil was out with a sinus infection, Dave is off running a half marathon, so the three of us prettied up the triangle.

Next week we're taking the whole weekend off, which is why we wanted to get the big mower out there and get the whole thing cut in one weekend.

We're hoping that the grass growing will slow down to allow us some headstone raising and detailing, and we'll also be starting on the GPS locating and documenting soon (we hope, grass permitting).

Keep checking the updates, as more and more candidates are responding about their support for SB983. Elections are 12 September, so make sure you know who will support a bill that will finally regulate pet cemeteries before you go cast your vote.

I sincerely ask the website be modified on the reporting of SB 983 in that it cites that "the Republican Party" as being against this bill. As you state, the bill passed the Senate which means all Republican Senators supported it.

Thanks for bringing this issue to my attention. The Aspen Hill Pet cemetery is
in my neighborhood. I was very familiar with the possible development there;
however, I believe it was on land were no burials had taken place. Since SB
983 did not come to either my Juciciary Committee nor to the House floor for
discussion. I have not explored the issues that surround the bill. Right now
just a few weeks out from the election, I am not making pledges nor commitments
on bills where I've only heard one side. Your support seems quite reasonable,
but I would need a period of study and discussion on the issue from both sides
before I make a commitment. My 20 years in the House of Delegates has
persuaded me that quick commitments on new issues is not wise for a legislator.

I've reviewed the bill, and the only thing I would not agree with is the provision for the pet cemetary owner to move the interned pet to another cemetary after 90 days of the owner cannot be locaetd. Other than this provision, I feel the bill is reasonable, and I would certainly vote for it.

When asked why he wouldn't support moving interred pets, Mr. McBride responded:

Hello again, Penny. I think my division on this section is due to how I perceive the difference in importance between the remains of a pet, versus the remains of a human. To me, relocation of human remains as being the final responsibility of the owner of a cemetary for people is a reasonable accommodation. However, to be responsible for the reinternment of the body of an animal seems to me to present an excessive hardship to the owner of the pet cemetary. I can imagine after five or ten years that a lot of people would no longer care about whether their pet is reinterned in another cemetary, leaving a heavy burden to the pet cemetary owner.

I can, however, understand the provision being placed in the bill as a mechanism for preventing pet cemetary owners from fulfilling their duty to contact the owners in the event the body of the pet needs to be moved; who's to say that the pet cemetary did not try contacting the pets' owners prior to the redevelopment of the land? I think this issue of who holds final responsibility for pet reinternment may be best left as a contractual provision between the pet cemetary and the owner, which at most may result as a civil breach of contract dispute between the two parties. I think a legislative mandate bearing criminal repercussions is a satisfaction best left for failure to reintern a human body.

Thank you for your note. I am a dog owner and understand how deeply the loss of a pet is felt. When my Black Lab, Rainbow, died after 13 great years, I was somewhat lost. She had me trained to walk her at 6am, 6pm, and 9pm. I found that I paced the house at 6, 6, and 9 for quite some time. Over my protests that we did not need another dog, my wife (wisely) found us another puppy. We just celebrated the 5th birthday of “Libby” (Liberty), our chocolate Lab. Even though Rainbow has been departed for more than six years, I occasionally slip and call Libby Rainbow. We had Rainbow cremated and we scattered her ashes in her favorite play area, while the kids left her Milk Bones.

I am very sympathetic to the issue of proper remembrance of those who have passed away, both human and companion animals. And if elected I will certainly give this Bill a sympathetic hearing. But I think it is pre-mature to tell you how I would vote on this or any other Bill prior to being elected or hearing all sides of an argument. The easy thing to do would be to tell you what you want to hear just to gain your support. That is election year pandering, and it is part of the system I want to change ... Where candidates say anything to get elected then do anything else once elected.

In clear conscience, the best I can give you is a promise to listen to the merits of the Bill and vote (not stall it to keep it from coming up.) I know it’s probably not what you want to hear, but it is an iron clad promise to treat you and this issue with the respect you deserve.

Thank you for sending me the information about SB 983. I have a wonderful 12 year old Portuguese Water Dog and can truly understand why this is an important issue.

I reviewed your web site and noted the Bill was referred to a summer session study. The recommendations from that study need to be reviewed when they are available.

I believe in order to serve well in public office one must contribute to a culture of accountability and make a commitment to really listen - so we can gain collective insight and create partnerships in order to address your issue and others that are important to us.

I came into this race only recently, after former Delegate Dick D'Amato decided not to run. I am working hard to make up for lost time. I am committed to tacking this important issue.

My position on any particular piece of legislation including this issue will be based on all of the details of the proposal, reading the results of the summer study, and listening to the analysts in State Government. It is important we make sure the legislation as drafted actually achieves the desired goal without unintended consequences. I welcome the opportunity to work with you in the future. I do believe it is an important issue that needs to be addressed.

Today was BIG mower day, and boy that thing certainly cuts well, and cuts the mowing time in half (plus we don't have to push it, so its a lot easier work).

The grass has gotten pretty high in places, and we'll have to do some weed cutting as well, but so far today the right side and circle are done, the back half of the left side is done, and we'll be out tomorrow to finish it up (can't leave it almost done).

Here is Dave, back from his trip to Italy with Choppy II. Apparently Lowes called and told him that Choppy I was dead, not fixable, so here is Choppy II. While we mowed with the big mower, he went around and cleaned up around the places the big mower couldn't go.

Here is the circle after we mowed. Since the big mower doesn't have a grass catcher, we'll have a lot of grass to rake up later, but hey, it looks so much better mowed.

Here's Betty at the wheel of the big mower and Dave doing some trimming. Dan is pulling up flowers and candles so we can mow.

Even though we're not pushing mowers, its still a LOT of walking. A few people at the front of the mower (to make sure there isn't anything dangerous sticking up that the blades will hit) and removing flowers or memorials, then putting them back where they belong once the mower passes.

As I said, we'll be out again tomorrow around 9 am to finish up the left side and the rest of it. Its very pretty when its mowed.

Gosh that grass gets high :)

The front left got mowed today. We're very glad the heat wave is over with, but it was still pretty hot out there. It seems the grass likes the heat too and continues to grow very well.

Our work was admired by the woman that is now living in the house... she complained to herself (loud enough for us to hear as she drove by) about all of the trash bags of grass clippings we lined up along the road. Oh well.

Afterwards we ate too much ice cream at Coldstone (hope your leftovers made it home before they turned to soup Jeanne) :)

I continue to receive a lot of responses to the question we e-mailed out to all of the candidates. I'll continue updating each district and I'll start adding the Senate responses, which have been very favorable as well.

Please find your district and read who has responded, because these are the people that will be representing you in Annapolis next year when we go before the House and Senate again with our Pet Cemetery bill.

We all need the protection of this bill, not just for Bonheur, but also for the many pet cemeteries that could end up like it. We would also like to see Bonheur maintained, per the law, by the owner, not concerned citizens.

Penny, If I remember correctly, the sub-committee had a lot of questions about the contracts. Sometimes when we get a bill late in the session it is hard to do the due diligence required for passage. Existing pet cemetaries deserve full protection. Even without deeds,
plots in both human and pet cemetaries are sacred grounds.

However, we must understand that creation of new cemetary locations must
be closely regulated. As the call for new living space increases we must
preserve our sacred places, our historic places, and our protected
forests, wetlands, parks, and wild places. There must be careful planning
of all land use. People should be encouraged to live near their work and
sources of supply and entertainment.

In my mind big projects that call for public domain takeovers are, as
often as not, ill founded.

the regulation of pet cemeteries. I have been aware of and admired the Aspen
Hill Pet Cemetery all my life, having grown up near Aspen Hill.

Protection for pet cemeteries seems appropriate, although I don't know if all
the legal details pertaining to human cemeteries would be applicable. I would
certainly be inclined to support your bill in the House of Delegates.

Please know that I also support humane treatment of all animals, and effective
enforcement of animal-protection laws. I am concerned about the increase of
violence in our society, especially the training and use of animals for
violent purposes, such as dog fighting. I will be keeping an eye on this
subject, and would appreciate any information or views from you or your
associates on the matter.

I have lost a cat and three dogs in my life time. My cat Fluffy, my dogs Bronco, Fluffy, and Blu. Fluffy my cat, and Bronco were inseparable. Loosing Bronco was heartbreaking, man how I cried. Blu was my boy, he traveled with me all the time. My friends and family still talk about Blu to this day. We miss him. Certainly you have my vote. And I was there testifying in another matter the day you guys were testifying before the Senate Finance Committee back in Early Spring about the horrid conditions of the cemetery. I remember older gentlemen talking about his World War II buddy who lost his dog during the war. How is he by the way? He was in tears. And I remember the lady talking about her rabbit. I am the Delegate who sponsored the Ferret Protection Act and have been given a hard time by my opposition in the election as well as the State Republican Chairman, who has since apologized for causing me such grief. The Ferret Protection Act was designed as a consumer protection bill so that ferret pups were not taken too early from their mothers just as we protect kittens and puppies. In fact, one Ferret Rescue Center has taken in over 3,000 ferrets in eleven years. This is almost a ferret a day. Ferrets are the third most popular pet behind dogs and cats. I do not nor have I ever owned a ferret. I have two cats and I understand the sadness of losing a pet and wanting to make sure that "your best friend" has a permanent and final resting place that is not going to be paved over for a parking lot or a new subdivision. This is really a consumer protection issue and should be presented in that manner. In addition, there is now a Maryland State Bar Subsection of Attorneys who specialize in animal law so this issue may be something that they would be interested in pursuing. As society gets more fractured, many times it is the family pet that is really man or woman's best friend and that best friend deserves a proper burial and internment.

So yes, if re-elected I would support such a bill since I was involved with several animal bills regarding civil damages as well as cruelty. I have received a 95 % rating from the Humane Society.

To be honest with you, this is a completely new issue for me. Your legislation seems very reasonable and I look forward to reviewing it further in office.

As I have canvassed district 23A, over 5500 homes so far, I estimate that a majority of the homes have pets -- mainly every type of dog under the sun. I have considered assembling a photo gallery titled the "Dogs of 23A" on my website and have actually started taking a few photos. There are a lot of friendly pets out there.

It is both unconscionable and morally wrong for those individuals who have secured the final resting place for their family pet to have to endure the emotional impact of unscrupulous developers. At best Rosa Bonheur Memorial Park and other cemeteries like it should be preserved through memorial funds established by those who have chosen these areas for their pets final resting place. At worst, the developers should provide notification and financial assistance to help families recover and relocated their pets remains to a location of the pet owners choice. I would likely support a measure that delivered emotional support and private financial assistance to accomplish your stated goals.

I believe that many of Maryland's laws are not oriented toward protecting consumers -- and this is particularly so with regard to cemeteries and other related services (such as funeral home services). If elected, I will be glad to support the effort to ensure proper regulation of pet cemeteries -- and I will vote to ensure that they are regulated at the same level as human cemeteries.

Also, I will support efforts to break the hold of the Maryland Assocation of Funeral Home Directors over funeral home policies. For example, under MD law, to own a funeral home, a person must be a licensed mortician unless the person holds one of the limited number of licenses exempt from this requirement. There is no reason why a funeral home owner must be a licensed mortician -- the owner can employ licensed morticians. Similarly, there is no reason that facilities that provide only cremation services should have to employ morticians as no embalming is occuring -- but again, that is a requirement under existing Maryland laws and helps ensure that licensed morticians have little competition. If elected, I will work to ensure that all aspects of funeral home/cemetery (including pet cemetery) businesses are properly regulated AND that regulations are in the best interests of consumers.

I think there is general consensus that legislation similar to SB 983 is important and necessary and I am fully prepared to support such legislation. However, the bill was not cross-filed in the House and came over to the House extremely late. Several legitimate questions arose during the final days of the Session in terms of implementation/enforcement at a time when the Committee was quite frankly preoccupied with the high profile electric rate/BGE issue. To enhance the likelihood of passage in 2007, I would strongly suggest that an identical bill be introduced in both the House and Senate, i.e. referred to as a cross-file. This will allow the Committee ample time to resolve any concerns it has.

I have a 7.5 year old abuse rescue dog who I love more than I could ever express, and I cannot imagine the pain of guardians who have had the remains of their animal companions who have passed desecrated. Moreover, their reasonable expectations as consumers was violated.

I have read through the text of the bill (and personally supported it last year, though I was, sadly, not involved in advocacy), and agree strongly with the contents. Throughout this campaign, every time a person or organization has asked me to support or sponsor specific legislation, I have given my opinion of the idea in question or the previous bill, and then stated that I will not promise to support anything that I have yet to read as it will be introduced. Therefore, I support the text of SB983 and I support the idea presented, however, I will not make a promise I cannot keep, and will not promise to introduce or support specific legislation until I read it.

Also, I am exceptionally offended by pet protection bills being labeled as "silly" - as the makers of the list you linked to on your website does. Pets are important to many people, myself included. Requiring human decency to pets is also a moral and ought to be a legal obligation. Moreover, the legislation introduced simply makes good sense as a consumer protection, regardless of one's feelings about animals.

Thank you for contacting me regarding this issue. As a lifetime dog owner and
pet-lover, I have experienced the profound relationships that develop between pets
and their owners. My dog Murphy (German Shepherd / Irish Setter mix) and I, for
example, were truly the best of friends, and we even traveled around the country
together many times. The day he died was probably the saddest day in my life.
However I must tell you that I did not even think of burying him in a cemetery, but
instead I brought his body to the ASPCA off of Falls Rd. in Baltimore. I was startled
when a couple days later they called me to say I could "pick him up!" What they
meant, of course, was that I could get his ashes which evidently I had paid for
(cremation) but which I did not knowingly request, nor did I want his ashes.
For me a pet is sacred when he or she is alive but their dead body or ashes are
frankly not of much concern to me. That doesn't mean that I would dump the body
on a road, but it does mean that a simple hole in the ground or cremation, etc. is
adequate by my standard. I fully understand that you and you group's members have the exact opposite view and I respect that.

I also understand that my comments may shock you and will probably preclude your group from considering voting for me. But I made a pledge to myself that I would always be candid and honest if elected and I am not going to act differently now in hopes of winning my election through deceit.
As for you specific issue: I had not heard of this issue before, so my comments (below) reflect only a few minutes worth of reflection on the issue:
If pet owners contracted with pet cemeteries for goods and services for a fee then certainly the owners of the pet cemeteries must make good on those contracts.
If there is no contract, or if the contract does not stipulate the length of time that the animals will be interned or their internment conditions, then I am not sure what the state can or should do about this. I guess at the very least the owners should be allowed to retrieve their pets bodies at their own expense for internment
elsewhere.
I'm not sure we need any new laws to cover this-- I think this is one time when the "free market" may be sufficient. Pet cemetery owners should use this example to differentiate their services (and justify their prices) to the public.

I always thought Rosa Bonheur was in an unuusal location and always looked run down for as long as I can remember. I think all deed holders should be notified if it has been less than X number of years (maybe 20 years). They didn't get the big things done in Annapolis, so I'm not surprised that they didn't get this done. If elected I would be in agreement with the unanimous Senate vote, and vote for approval of Senate Bill 983, entitled Business Regulation - Pet Cemataries. This was a good business bill, in that it would have provided for oversight and regulation of an industry that either has or will be of great meaning to many of us. There was also no impact on the fiscal impact to the government, so I feel this would be most beneficial to the citizens of Maryland.

I have never promised to vote dole a bill that is not in front of me. Too many times, a bill changes from a preliminary discussion to the final version.

Here's my best answer. If the bill were written exactly like the bill Stone filed before, I would vote for that. Otherwise, I'd need to see the exact language of a new bill before making you a promise.

Certainly pet owners should be assured that once a pet has been interred in a designated pet cemetery, those remains are guaranteed to be protected from destruction without sufficient notice to the deed owners should the cemetery fail for any reason . I would certainly be in favor of such legislative protection.
